By Oche Alechenu __
The Federal Capital Territory High Court sitting in Abuja, earlier on Tuesday has scheduled 17th October to rule on the case application filed and suit instituted against Mr Peter Nwachukwu, the husband of the late Gospel Singer, Osinachi, in quest to the homicide and domestic violence-related by the Office of the Attorney-General of the Federation dated June 3rd, 2022.
Mrs Osinachi Nwachukwu, the wife of the accused died on April 8th, 2022. The public and the lovers of her works including her colleagues in the Gospel music Industry had vehemently suspected her husband, Mr Nwachukwu who was said to have maltreated her wife several times through physical tutures and other means which have lead to her untimely death from the stage.
When the ugly incident occurred, Mr Nwachukwu was arrested by the men of Nigeria Police and subsequently detained while serving remands led by Justice Njideka K. Nwosu-Iheme at the Kuje Correctional Facility in Abuja and later handed his case file to the OAGF for further investigation.
It is noted by our reporters that, Mr Nwachukwu trials commenced on since June 20th, 2022 with the prosecution calling about 17 witnesses in view to give concrete evidence before the court but was later closed on March 10th, 2023. He had pleaded not guilty to the 23 count charges labeled against him ranging from domestic violence and homicide, among others.
During the trial, Mr Nwachukwu’s lawyer, Barrister A. Aliyu, was said to have filed a no case submission. This signified that, his client (Mr Nwachukwu) has no case to answer and every of the allegations before the court are forced against the him.
The defendant cited that, all the evidence and reports of medical practitioners presented by the prosecution wholy exonerated his client (Mr Nwachukwu) from the charge of culpable homicide as claimed.
The lawyer continued and noted that, the medical practitioners gave their testimonies on account that the deceased (Osinachi) did not suffer any form of violence resulting to her death. He further added that his client's wife died, "solely as a result of outgrowth tumors, which resulted in cardiac tamponade, the primary cause of death and abnormal growth of tissue (cancer) which is secondary cause of death."
The lawyer insisted that the Nwachukwu's in-laws are only trying to frame up cases against his client holding up on the autopsy which "shows there was no mark of violence on the deceased at the time the autopsy was conducted."
The lawyer further insisted that the testimonies given the children of his client (Mr Nwachukwu) who are apparently 14 years and below, that they were tutored against their father, he stood on his ground as Justice Iheme adjourned the case till next ruling in same court.
